Montgomery County foreclosure rate plummets in March

Montgomery had the second-lowest rate in the state by Gazette Staff The rate of home foreclosure filings in Montgomery County last month plunged 39.9 percent from February and 44.8 percent from March 2011, according to data in a new report from RealtyTrac of Irvine, Calif. The statewide rate in March also fell, although not as steeply: 3.7 percent and 28.1 percent, respectively. With one foreclosure filing per 3,722 households, Montgomery had the second-lowest rate in the state. About 23.5 percent of all homes sold in Maryland in the second quarter were in some stage of foreclosure, down from 30.6 percent in the first quarter but up from 17.6 percent in the prior-year quarter.

There were 3,866 foreclosure sales in the state in the second quarter, according to new data from RealtyTrac of Irvine, Calif.

More than one-third of those sales were in Prince George’s County, where 40.1 percent of all home sales involved a foreclosed property....

...Those prices varied wildly across the state, from an average county low of $62,099 in Garrett County to a high of $301,979 in Howard County.

U.S. foreclosures fall in July -RealtyTrac

NEW YORK Aug 11 (Reuters) - The number of U.S. homes that received foreclosures filings fell to a near four year low in July, a survey said on Thursday.

Notice of default, auction sale or bank repossession were sent to 212,764 properties in July, the lowest number since November 2007, real estate data firm RealtyTrac said.

That represents a 4 percent decrease over June and a 35 percent decrease over last year.

"The downward trend in foreclosure activity has now taken on a life of its own," James Saccacio, CEO of RealtyTrac, said in a statement. The robo-signing controversy last year, which forced banks to slow the pace of foreclosures, plus government programs to help struggling homeowners stave off repossession may explain the drop, he said.

Foreclosure sales dip for second straight month

Mortgage servicers completed 68,000 foreclosure sales on the courthouse steps in May, down 7% from the previous month and the second straight month of declines, according to the Hope Now alliance of insurers, counselors and lenders.

Foreclosure sales dropped 14% in April. However, servicers started 176,000 foreclosures in May, up 8% from the previous month. Roughly 2.67 million mortgages remained in 60-day delinquency, up 1% from the previous month.

Modifications remained flat at roughly 85,000 through private initiatives and the Home Affordable Modification Program.

Private modifications dipped to 53,000 in May, a 7% decrease. In April, the drop on private workouts was 26%, allowing HAMP to take a larger share of completed modifications. Servicers completed 32,398 permanent HAMP modifications in May, up 12%

Borrowers unhappy with Obama mortgage plan: study

WASHINGTON (Reuters) - Struggling homeowners seeking help from the Obama administration's foreclosure prevention program have in many cases had negative experiences, a congressional report said on Thursday.

Three-fourths of the some 400 housing counselors involved in the process characterized borrowers' overall experience with the housing program as "negative" or "very negative," according to the Government Accountability Office (GAO) study.

According to the study, 40 percent of approximately 300 counselors said they had experienced difficulties working with the mortgage servicers and said paperwork had been lost or needed to be resubmitted.

The Treasury Department defended its actions, noting that the survey was conducted in October 2010 before improvements were made.

NewsWatch: Foreclosure sales drop in third quarter

The number of foreclosure sales in Maryland in the third quarter dropped 47.6 percent from the second quarter and 17.0 percent from the third quarter of 2009, according to new data from RealtyTrac of Irvine, Calif.

A total of 2,338 such homes sold in the third quarter, at an average price of $207,544, or an average discount of 35.9 percent. That was 17.0 percent of all homes sold in the quarter.

Prince George's County had the highest percentage of foreclosure sales in the quarter — 33.6 percent of all home sales.

The state data reflected the national numbers, which also showed quarterly and year-over-year decreases. The average national sales price of a foreclosed home was $169,523.

State agencies back Allegheny merger offer

Allegheny Power's residential customers in Maryland would share $6.5 million in credits over four years and the western part of the state would get a regional headquarters as part of a proposal to approve the electric utility's merger with FirstEnergy Corp. of Akron, Ohio.

Although Maryland agencies, several unions, four local governments and an industrial customers group have signed off on the deal, the state's Office of the People's Counsel has not approved, Deputy People's Counsel Theresa V. Czarski said Thursday. Its objections are expected to be filed with the Public Service Commission today.

The proposal was filed with the PSC on Wednesday. The commission has until Jan. 7 to act on the proposal, under which Allegheny Power would become a subsidiary of First Energy, which already owns seven utilities in Ohio, Pennsylvania and New Jersey.

Allegheny of Greensburg, Pa., has about 250,000 customers from northwestern Montgomery County, north into Frederick and Carroll counties and west through Garrett County. Of those, only the 220,000 residential customers would share the credits.

Don't underestimate foreclosure crisis, watchdog to warn

A congressional oversight panel is set to warn on Tuesday that a widespread problem of flawed and fraudulent foreclosure paperwork could upend the housing market and undermine the nation's financial stability, just as the issue is coming under greater scrutiny this week in Washington.

The report, issued by the Congressional Oversight Panel, which monitors the government's bailout program, marks the first time a federal watchdog has weighed in on the nationwide foreclosure mess.

The panel echoed concerns raised by consumer advocates and financial analysts, who have said that although the consequences of the foreclosure debacle remain unclear, the problems could throw into doubt the ownership not only of foreclosed properties but also the millions of ordinary mortgages that were pooled and traded by investors around the world.

The report is scheduled to be released in the morning, just before the Senate Banking Committee holds a hearing on the matter and as lawmakers are considering several legislative responses.

U.S. urges lenders to vet foreclosures but keep process moving

Federal regulators on Wednesday urged the nation's lenders to verify that paperwork filed as part of the foreclosure process was properly reviewed and to file new documents if problems are found.

But regulators also said that lenders should continue as quickly as possible with foreclosures when no problems are found. Their comments, fashioned in close consultation with the Obama administration, demonstrate how federal officials and the White House are at odds with Democratic leaders in Congress, who favor a national freeze on foreclosures.

The framework outlined by the Federal Housing Finance Agency, is the most elaborate federal response so far to the foreclosure debacle buffetting the housing and financial markets.

Banks repossess homes at record pace: RealtyTrac

NEW YORK (Reuters) - Banks repossessed a record number of U.S. homes in the second quarter, but slowed new foreclosure notices to manage distressed properties on the market, real estate data company RealtyTrac said on Thursday.

The root problems of job losses and wage cuts persist, making a sustained U.S. housing recovery elusive.

Banks took control of 269,962 properties in the second quarter, up 5 percent from the prior quarter and a 38 percent spike from the second quarter of last year, RealtyTrac said in its midyear 2010 foreclosure report.

Repossessions will likely top 1 million this year.

"The underlying conditions haven't improved," RealtyTrac senior vice president Rick Sharga said in an interview.

The housing market still grapples with "unemployment, economic displacement in general, and still sits on over 5 million seriously delinquent loans that in all likelihood will at some point go into foreclosure," he said.

In 2005, the last "normal" year in housing, Sharga said, about 530,000 households got a foreclosure notice and banks took over a comparatively minuscule 100,000 houses.

This year more than 3 million households are likely to get at least one foreclosure filing, which includes notice of default, scheduled auction and repossession, Irvine, California-based RealtyTrac forecasts.

Foreclosure solutions workshop planned at HRDC

— CUMBERLAND — Local residents facing foreclosure, worried about increased interest rates or having other concerns about their mortgage can access some free legal advice in a workshop being sponsored by state Sen. George C. Edwards.

The Foreclosure Solutions Workshop will be held from 2 to 6 p.m. on July 15 at the Human Resources Development Commission at 125 Virginia Ave.

Homeowners who are facing foreclosure, worried about an increased interest rate or have other concerns about their mortgage can receive free one-on-one legal advice and housing counseling assistance at the event.

“The mortgage crisis isn’t just something we see in the news: it affects many individuals and families in our community,” said Gorman E. Getty III, president of the Bar Association of Allegany County that is coordinating the event along with Allegany Law on Greene Street. He noted that the Bar Association “has a long tradition of helping those in need and is committed to assisting with mortgage related issues.”

Marcia Conrad, executive director of Allegany Law which was founded by the Bar Association, said she is “delighted to be able to offer this service to distressed homeowners.”

“This is the first time that the Foreclosure Solutions Workshop is being offered in Western Maryland. Over 60 workshops have been successfully held throughout the state during the last two years,” said Conrad.

Allegany Law and the Bar Association of Allegany County have been working with the Maryland Foreclosure Prevention Pro Bono Project of the Maryland Pro Bono Resource Center of Maryland to plan and staff the event. Homeowners should call Allegany Law at 301-722-3390 to register.

Registration guarantees a free legal consultation with a volunteer attorney to discuss an individual mortgage situation. The workshop will give participants directions on the next steps to take and where to go for help.

Workshop participants should bring the following: (1) all materials related to their current and former mortgages, including the loan application, settlement paperwork and lender statements; (2) any foreclosure notices or threats of foreclosure received; and (3) a monthly household income and expense budget.

Jennifer Larrabee, manager of the Maryland Foreclosure Prevention Pro Bono Project and housing counselors from Garrett County Community Action Agency and Consumer Credit Counseling Service of Maryland and Delaware will be also participate in the workshop.

Maryland bill provides foreclosure mediation for homeowners

Beginning this summer, Maryland homeowners at risk of losing their properties will have another option to stave off foreclosure.

The Maryland General Assembly this week approved a mediation program that will give homeowners a chance to meet with lenders and an administrative law judge to discuss ways to stay in their homes.

The bill, proposed by Gov. Martin O'Malley (D), takes effect July 1, and should be fully implemented by mid-August.

"This is an opportunity for those who fall through the cracks," said Del. Doyle L. Niemann (D-Prince George's), a sponsor of the bill, referring to homeowners who have requested loan modifications but still find themselves facing foreclosure. "Many people say they don't get a response from their lender. They talk to different people on the phone when they call or their paperwork gets lost."

Under the legislation, the lender is required to send an application for a loan-modification or loss-mitigation program to the homeowner -- which the homeowner can use to seek help -- at least 45 days before a foreclosure action is filed in court. The bill requires the lender to pay a $300 fee for a foreclosure filing.

Garrett County has the lowest foreclosure rate in Maryland - Gazette.net

Legislation requires lenders to help stem foreclosures
State had 10th highest rate in U.S. last month

Foreclosures jumped to 5,732 in February across Maryland, up 9.6 percent from January and 80.5 percent from a year earlier, according to Irvine, Calif., data company RealtyTrac. Maryland's rate of one foreclosure filing for every 407 households was the 10th highest in the nation, up from 13th in January and 16th a year ago.

Prince George's County continues to lead the state in the number and rate of foreclosures with 1,789 filed last month, or one for every 179 households. Baltimore city and the counties of Frederick, Charles, Calvert and Kent also had foreclosure rates above the state average. Garrett County had the lowest rate in the state last month, with only eight foreclosures or one filing per 2,378 housing units.

Meanwhile, foreclosure filings across the nation slowed last month. They were down 2.3 percent from January and up only 6.2 percent from a year ago.

Lt. Gov. Anthony G. Brown (D) went on the offensive last week to lobby for legislation that would require lenders to work with homeowners to modify their loans before filing foreclosure orders. The businesses would have to send homeowners a detailed explanation of requirements for the lenders' loan modification program and a loss mitigation application, among other items.

The lenders would have to file affidavits stating that a loan modification review had been done and the reasons they denied modifying the loan. They would also have to document that alternatives other than foreclosures were considered. Homeowners who have not received the loan modification review would be able to request a foreclosure mediation session.

"This legislation will provide homeowners a chance to explore any and all options to find a positive resolution and remain in their homes," Brown said in a speech at the Ebenezer African Methodist Episcopal Church in Fort Washington, according to his office.

Kathleen Murphy, president and CEO of the Maryland Bankers Association, also testified last month, saying she was concerned that a loss mitigation analysis would be required before a foreclosure could be filed, according to an Associated Press report. A foreclosure filing often prompts borrowers to talk about loss mitigation, Murphy said.

Among states, Nevada's rate of one per 102 households led the nation last month, while Vermont posted the lowest rate with one filing per 39,077 units.

Foreclosures in Maryland are increasing despite state officials claiming that a counseling and legal program has provided more than $5.5 million in assistance and helped about 11,000 homeowners avoid foreclosures since mid-2007. The state has also enacted other measures, such as a mortgage fraud protection law and a streamlined loss mitigation process with six of the largest servicers in Maryland.

Factors for the increase in foreclosures despite efforts to remedy the situation include the sour economy, according to a recent analysis by the state Department of Legislative Services.

"Despite the impact of extensive state legislative and consumer outreach efforts ... total foreclosure activity in Maryland continues to increase as state residents feel the effects of rising unemployment and declining home values," the department reported.

Home sales rise

The volume of existing homes sold in Maryland rose by almost 20 percent in February from February 2009, but the average sales price of about $280,000 was down by 7 percent, according to the Maryland Association of Realtors.

The extended and expanded federal homebuyer tax credit is helping fuel sales in Maryland, according to the trade group. The $8,000 credit for first-time homebuyers runs until April 30 for signed contracts and June 30 for closings. There is also a tax credit of up to $6,500 for certain existing homeowners who purchase a replacement principal residence.
